Cardstock: Habit Cards

These terms cover the iOS app Cardstock, listed on the App Store as “Cardstock: Habit Cards.” The agreement is between you and us, AboveTheFold.dev (“we” or “us”), not with Apple. We are solely responsible for the app and its content.
Apple’s Licensed Application End User License Agreement also applies: apple.com/legal/internet-services/itunes/dev/stdeula. Where one of Apple’s required terms conflicts with these terms, the Apple term controls for that point.
We grant you a non-transferable license to use Cardstock on Apple-branded products you own or control, as permitted by the usage rules in Apple’s media services terms. The app is licensed, not sold. You may not sell, rent, redistribute, or reverse engineer it, except where the law does not allow that restriction. Accounts associated with the purchaser may access the app through Family Sharing or volume purchasing, as Apple’s usage rules allow.
The Deck is an optional purchase. The price is shown in the app, on your App Store storefront, before you pay. This page does not quote a price.
Without The Deck:
With The Deck you can have 3 active cards. Three is the maximum. The Deck is not an unlimited number of cards.
The Deck is available as a yearly or a monthly auto-renewing subscription. The yearly subscription renews every year and includes a 7-day free trial for new subscribers. The monthly subscription renews every month.
The price and the length of the subscription are shown at purchase. Payment is charged to your Apple ID when you confirm the purchase. The subscription renews unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends. You can manage or cancel the subscription in your Apple ID settings. Any unused part of a free trial is forfeited when you buy a subscription.
The lifetime option is a one-time purchase. It does not renew. It unlocks The Deck for the Apple ID that bought it.
If a free trial ends and you do not subscribe, or a subscription ends and you do not have the lifetime purchase, you return to the free allowance. Active cards beyond that allowance are frozen, not deleted. The oldest cards keep their place.
A frozen card is paused. The app does not add automatic O marks, you cannot mark the card, and its reminders stop. When you have The Deck again, the card resumes at the same day number.
Refunds go through Apple, not through us. Apple’s refund rules apply. You can start a request at reportaproblem.apple.com.
Cardstock is a habit tool. It is not medical, psychological, or other professional advice, and it is not a medical device. A card does not diagnose, treat, or prevent any condition.
We are responsible for maintenance and support of Cardstock. Apple has no obligation to provide maintenance or support for the app.
If Cardstock fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation for the app. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
To the extent the law allows, Cardstock is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted or free of errors.
To the extent the law allows, we are not liable for indirect, incidental, special, or consequential damages, including lost data, lost habits, or lost profits. Our total liability for claims relating to the app is limited to the amount you paid Apple for The Deck during the 12 months before the claim. These limits do not apply where the law does not allow them, including liability for death or personal injury caused by negligence, or for fraud. Rights that cannot legally be waived still apply.
We, not Apple, are responsible for product claims about Cardstock and for any claim that the app infringes someone else’s intellectual property. You must comply with third-party terms that apply to your use of the app, including your agreement with your wireless carrier.
You represent that you are not located in a region that is subject to a U.S. government embargo or that has been designated by the U.S. government as “terrorist supporting,” and that you are not listed on any U.S. government list of prohibited or restricted parties.
Apple and Apple’s subsidiaries are third-party beneficiaries of these terms. When you accept them, Apple has the right, and is deemed to have accepted the right, to enforce them against you.
These terms are governed by the laws of Greece. If you live in another country, you keep any mandatory consumer protections that the law of your country gives you, and you may bring a claim in the courts where you live.
